		TERMS AND CONDITIONS
1.This is an international competition open to entrants of all ages.
2.Minors need parental permission to claim prizes.
3.Only individual entrants are allowed.
4.Entrants are not permitted to enter works on behalf of any other individual or entity.
5.All entries should be original and not a derivative of existing work, including works previously entered in other competitions.
6.Multiple entries are permitted.
7.Entries should remain unpublished outside of MotionElements prior to the close of this competition.
8.Submitted works must conform to nominal decency guidelines. Any work deemed to contain content that depicts violence, racial, political, religious, and sexual or any other inflammatory material in an inappropriate manner will be disqualified and removed. Interpretation of what is, and is not, appropriate material is at the sole discretion of MotionElements.
9.Neither MotionElements nor its sponsors will be held responsible for late entries for any reason whatsoever. It is the sole responsibility of the entrants to make reasonable allowances for upload times and to plan accordingly.
10.Entries will be judged on artistic and technical merit within the scope of the competition theme, and real world applicability. The interpretation of these rules, the theme, artistic or technical merit, the real world applicability of the work and any other consideration made by the judges is at the sole discretion of the judges.
11.MotionElements reserves the right to change or add to the prizes and substitute with a comparable alternative. Any changes will be posted on the competition blog. Prizes are non-transferable and no cash equivalent will be offered. MotionElements has the right to withhold prizes in the event that the judges deem the quality of the submitted entries to be unsatisfactory.
12.Judges' decisions are final and no correspondence will be entered into.
13.To be eligible for prizes, all winning entrants must provide accurate and reliable contact details. MotionElements will make all reasonable efforts to contact winners for a period of 14 calendar days after the completion of judging. If a winner cannot be contacted within this period then they can be disqualified at the sole discretion of MotionElements.
14.Any import taxes or duties on prizes must be paid by the prize winner. It is neither practically possible nor ethically reasonable for MotionElements or any of the sponsors to pay duties and taxes on behalf of a winner. MotionElements and sponsors will not make false valuation claims to assist winners from illegally evading any applicable duties and taxes.
15.By entering the competition the entrant warrants that they are the sole copyright holder and indemnifies MotionElements and sponsors from any subsequent claims that may arise regarding ownership, or any other claims that may impact upon the entered work.
16.The entrant grants MotionElements rights to use all entered works, in any media for marketing and merchandising, provided full and correct credit for the artist clearly appears with said materials.
17.The entrant grants the sponsors rights to use all entered works on sponsors websites in the form of free public galleries, in any form of media, including, but not limited to, web galleries, physical galleries, downloadable form, wallpaper collections and screensavers, provided full and correct credit for the artist clearly appears with said materials.
18.The entrant grants MotionElements and sponsors rights to use the entrants name, imprimatur and likeness in conjunction with the use of their entered works in any media.
19.The entrant grants MotionElements and sponsors first right to publish their submitted work in any media.
20.Entrants commit to notify MotionElements in writing at least one week prior to the publication of their work in any media.
21.The entrant grants MotionElements the first right to host their entered works for sale to potential clients at MotionElements website, negotiable under a revenue sharing agreement with MotionElements.
22.Other than the rights assigned in the preceding clauses entrants retain copyright of all entered materials and are free to use said materials for personal promotions.
23.The entrant indemnifies MotionElements and sponsors against any claims or indirect, special, incidental, or consequential damages from any party that may arise from any use, including but not limited to, publication of entry materials submitted as a part of, or in association with the competition.
24.All artwork that is entered by the deadline is final; it cannot be removed or changed after this point. MotionElements will not return any material submitted or alter any entry.
25.The judges have sole discretion in the interpretation and enforcement of rules, including but not limited to suspension of categories and entrants.
26.It is the entrant's responsibility to ensure compliance with all rules. Disqualification of any entrant is not reflected in any public change of status or alteration of their entry.
27.There is no agreement or contract between the artist and MotionElements. The artist assumes all responsibility and costs for delivering works and other required information to MotionElements for consideration in the competition.
28.MotionElements does not require any payment for entry of works nor does MotionElements offer any form of payment, actual or implied, to any entrants.
29.There is no chance component in the selection of winning entries. Winning entries will be chosen solely on the skill exhibited by the entrants as determined by the judges.
30.MotionElements will take reasonable measures to ensure the security of entries and information supplied to them. In no event shall MotionElements be liable to any party, for indirect, special, incidental, or consequential damages arising out of the loss of works and data supplied, even if MotionElements has been advised of the possibility of such loss and damages.
31.Employees and relatives of MotionElements, sponsors and judges cannot compete in the competition.
32.MotionElements reserves the right to suspend, shorten, modify or cancel the competition at its sole discretion.
33.Handling of submitted personal information :
	The submitted private information will be used only for the following purposes. Without the consent of the entrants, MotionElements will not disclose any information outside the uses listed below.
	(1) The information will be used to present the prizewinners, including but not limited to: references in the MotionElements website and any publicity activities or publications of MotionElements.
	(2) The information will be used for exhibitions that MotionElements participate in, including but not limited to SIGGRAPH Asia 2008.
	(3) The information will be used to contact the entrants, including but not limited to: the notification of winning entries, any inquiries regarding the contents of a submitted application, and any other necessary inquiries.
	(4) The information will be used anonymously as statistics, intended for the improvement of this design competition's service and management.
	(5) The information will be used in the emailing of MotionElements e-newsletters to the entrants, with the option for entrants to unsubscribe from them.
34.This list of terms and conditions constitutes the complete and exclusive statement of the terms and conditions and supersedes any prior terms and conditions, oral or written, and any other communications relating to these terms and conditions.
